I understand that horseback riding and all equine-related activities are inherently dangerous. Horses are large, powerful, and unpredictable animals, and even well-trained horses can behave in ways that result in serious injury or death. I expressly acknowledge and voluntarily assume all risks of equine activities, including but not limited to: the propensity of a horse to behave in ways that may cause injury to persons on or around it; unpredictable reactions to sounds, movement, unfamiliar objects, persons, or animals; surface and subsurface hazards of riding areas; collisions with other horses, riders, or objects; failure of tack or equipment; the negligence of other participants or third parties; falls from horses at any gait; and bites, kicks, or strikes. I acknowledge these risks cannot be eliminated without destroying the unique character of the activity.
In consideration of being permitted to participate in any equine activity at Hussar Stables, and to the fullest extent permitted by applicable law, I hereby release, waive, discharge, and covenant not to sue Scrambled LLC dba Hussar Stables, its owners, officers, directors, employees, agents, contractors, volunteers, horses, and assigns (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by me or my minor child, whether caused by the negligence of the Released Parties or otherwise, while participating in any equine activity or while on the premises.
I agree to indemnify, defend, and hold harmless the Released Parties from all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of my or my minor child's participation, my violation of the Terms of Service, or any applicable law. I intend this release to be as broad and inclusive as permitted by California law; if any portion is held invalid, the remainder continues in full force and effect.
California Civil Code § 1542 waiver: I expressly waive all rights and benefits under California Civil Code § 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
I represent that the participant is in good physical health with no condition making equine activities inadvisable without physician clearance, and I agree to disclose any relevant medical condition, allergy, or limitation to Hussar Stables staff. In an emergency, I authorize Hussar Stables staff to seek emergency medical treatment for the participant and to contact emergency services, and I accept responsibility for all costs of such treatment. I acknowledge staff are not medical professionals and release the Released Parties from liability arising from first aid or emergency medical decisions made in good faith.
I agree that the participant will wear an ASTM/SEI-certified helmet at all times while mounted, will wear appropriate footwear, and will follow all facility rules and instructor directions. If signing for a minor, I represent that I am the parent or legal guardian with authority to bind the minor to this agreement, I assume all risks and execute this release on the minor's behalf, and I agree to supervise the minor during non-lesson times on the premises.
Photos and video of the participant may be taken during lessons, events, or on the premises. For a minor participant, no marketing use is made unless the parent or legal guardian opts in below. Adult participants who do not opt in may still appear incidentally in general facility footage. Any permission given here may be withdrawn at any time by emailing info@hussarstables.com.
I have read this entire agreement, I understand it is a legally binding release of liability including claims of negligence, I have had the opportunity to ask questions, and I sign it voluntarily. This agreement incorporates the Hussar Stables Terms of Service (hussarstables.com/terms) and remains in effect for all visits and activities until revoked in writing.
