1. Acceptance of Terms
By accessing the Hussar Stables website, booking any lesson, purchasing any membership, entering the premises, or participating in any activity offered by Scrambled LLC, doing business as Hussar Stables ("Company," "we," "us," or "our"), you ("Member," "Participant," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable federal, state, and local laws and regulations. If you do not agree with any part of these Terms, you must not use our services or enter our premises.
These Terms constitute a legally binding agreement between you and Scrambled LLC dba Hussar Stables. Your continued use of our services after any modification to these Terms constitutes your acceptance of the revised Terms. We reserve the right to update these Terms at any time without prior notice.
If you are entering into these Terms on behalf of a minor child, you represent and warrant that you are the parent or legal guardian of that child and that you have the legal authority to bind both yourself and the minor to these Terms.
Acceptance of these Terms electronically — including checking an acceptance box and typing your full legal name during online enrollment — constitutes a legally binding electronic signature under the U.S. ESIGN Act and California's Uniform Electronic Transactions Act (UETA), with the same force and effect as a handwritten signature. Hussar Stables retains a record of each acceptance, including the accepted Terms version, signer name, date and time, and network information.
2. Assumption of Risk — Equine Activity
Horseback riding and all equine-related activities are inherently dangerous. Horses are large, powerful, and unpredictable animals. Even well-trained horses can behave in ways that result in serious injury or death. By participating in any activity at Hussar Stables, you expressly acknowledge and assume all risks associated with equine activities, including but not limited to:
- The propensity of a horse to behave in ways that may result in injury, harm, or death to persons on or around them
- The unpredictability of a horse's reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals
- Hazards such as surface and subsurface conditions of the riding area, including uneven terrain, holes, and obstacles
- Collisions with other horses, riders, vehicles, or fixed objects
- The failure of any saddle, bridle, halter, or other tack or equipment
- Negligence of other participants, spectators, or third parties
- Physical exertion demands that may aggravate pre-existing medical conditions
- Bites, kicks, strikes, and other contact from horses or other animals on the premises
- Falls from horses, whether at halt, walk, trot, canter, or during jumping or obstacle work
You acknowledge that the risks described above are inherent to equine activities and cannot be eliminated without destroying the unique character of the activity. Your voluntary participation constitutes your express assumption of all such risks.
3. Release of Liability, Waiver, and Indemnification
IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN ANY EQUINE ACTIVITY AT HUSSAR STABLES, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE HUSSAR STABLES LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, VOLUNTEERS, HORSES, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, INJURY, OR DEATH THAT MAY BE SUSTAINED BY YOU OR YOUR MINOR CHILD, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, WHILE PARTICIPATING IN ANY EQUINE ACTIVITY, OR WHILE ON THE PREMISES.
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the premises or services; (b) your participation in any equine activity; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any activity of any minor child for whom you are responsible.
You acknowledge that this release, waiver, and indemnification is intended to be as broad and inclusive as permitted by the laws of the State of California, and that if any portion is held invalid, the remaining portions shall continue in full legal force and effect.
CALIFORNIA CIVIL CODE § 1542 WAIVER: You expressly waive and relinquish all rights and benefits under California Civil Code § 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive this provision with respect to all claims released herein.
4. Medical Authorization and Health Disclosure
You represent and warrant that you (and any minor child in your care) are in good physical health and have no medical condition, disability, or impairment that would make participation in equine activities inadvisable without prior written clearance from a licensed physician. You agree to disclose to Hussar Stables staff any medical condition, allergy, or physical limitation that may affect your ability to safely participate.
In the event of an emergency, you authorize Hussar Stables staff to seek emergency medical treatment on your behalf (or on behalf of your minor child) and to contact emergency services. You agree to be responsible for all costs associated with such emergency medical treatment. Hussar Stables does not carry medical insurance on behalf of participants.
You acknowledge that Hussar Stables staff are not medical professionals and that any first aid rendered is provided in good faith. You release the Released Parties from any liability arising from emergency first aid or medical decisions made on your behalf in an emergency situation.
5. Membership Terms and Conditions
Membership at Hussar Stables is offered on a monthly recurring basis with a minimum initial commitment of three (3) months. By enrolling in a membership plan, you authorize Scrambled LLC dba Hussar Stables to charge your payment method on file on a recurring monthly basis until you cancel in accordance with these Terms. After the initial 3-month commitment, membership continues month-to-month.
5.1 Enrollment and Activation
Membership is activated upon receipt of your first monthly payment and completion of a signed membership agreement. Access to the facility and scheduled lessons begins on the activation date. Memberships are personal and non-transferable.
5.2 Billing and Payment
Monthly membership fees are billed on the same calendar date each month. If your payment method fails, you will have a 5-day grace period to update your payment information. Failure to resolve a failed payment within 5 days will result in suspension of membership privileges. A $25 returned payment fee applies to all failed transactions.
5.3 Cancellation Policy
Memberships carry a minimum initial commitment of three (3) months and may not be cancelled during that period except as required by law. After the initial 3-month commitment, you may cancel your membership at any time. You may cancel online, without contacting us, from the Membership page of the member area (members.hussarstables.com/portal/membership), or by emailing info@hussarstables.com, or by texting (661) 486-4659. Cancellation takes effect thirty (30) days after we receive your request; your membership, lesson access, and billing continue through that 30-day notice period, and you will not be charged for any billing period that begins after the cancellation effective date. No refunds are issued for the billing period in progress when the cancellation takes effect.
5.4 Membership Freeze
Members may request a membership freeze of up to 30 days per calendar year for documented medical reasons or extended travel. Freeze requests must be submitted in writing at least 7 days in advance. Membership fees are not charged during an approved freeze period.
5.5 Membership Termination by Hussar Stables
Hussar Stables reserves the right to terminate any membership immediately, without refund, for violation of these Terms, the Code of Conduct, failure to pay, or any behavior that poses a safety risk to horses, staff, or other members. In cases of non-safety-related termination, 14 days' written notice will be provided.
5.6 Price Changes
Hussar Stables reserves the right to adjust membership pricing with 30 days' written notice. Continued use of membership services after the effective date of a price change constitutes acceptance of the new pricing. Promotional founding-member rates are guaranteed for twelve (12) months from enrollment. After the initial 12 months, founding memberships may be adjusted to then-current standard pricing with 30 days' written notice. If a founding membership is cancelled, re-enrollment is at then-current standard pricing.
5.7 Annual Prepaid Memberships
Annual prepaid memberships are billed once, in full, at a discounted rate in exchange for a full-year commitment. Annual prepaid memberships are non-refundable and may not be cancelled, paused, or converted to monthly billing before the end of the prepaid term, except where required by applicable law. Lessons within an annual membership remain subject to the scheduling, cancellation, and no-show policies in Section 6. At the end of the prepaid term, the membership does not renew automatically unless you elect to renew.
6. Lesson Scheduling, Cancellation, and No-Show Policy
6.1 Scheduling
Lessons must be scheduled in advance through the Hussar Stables booking system. Walk-in lessons are not available. Lesson times are subject to availability and may be adjusted by Hussar Stables with reasonable notice.
6.2 Cancellation by Member
Lessons must be cancelled or rescheduled at least 48 hours in advance to avoid forfeiture of the lesson. Cancellations made less than 48 hours before the scheduled lesson time will result in the lesson being forfeited without credit or reschedule. In cases of genuine emergency, Hussar Stables may, at its sole discretion, offer a makeup lesson.
6.3 No-Show Policy
Failure to appear for a scheduled lesson without prior cancellation constitutes a no-show. No-shows result in forfeiture of the lesson with no credit, reschedule, or refund. Repeated no-shows (3 or more within a 60-day period) may result in membership termination.
6.4 Cancellation by Hussar Stables
Hussar Stables reserves the right to cancel or reschedule lessons due to weather conditions, horse health, instructor illness, or other circumstances beyond our control. In such cases, a makeup lesson will be offered at no additional charge. Hussar Stables is not liable for any costs or losses incurred by the member as a result of a cancelled lesson.
6.5 Weather Policy
Lessons may be cancelled or modified due to extreme heat (above 100°F), lightning, heavy rain, or other unsafe weather conditions. The safety of horses, riders, and staff is the primary consideration. Weather-related cancellations will be communicated as early as possible via text message.
6.6 Late Arrival
Members who arrive more than 10 minutes late for a scheduled lesson may forfeit the lesson at the instructor's discretion. Lesson time will not be extended to compensate for late arrival.
7. Code of Conduct and Facility Rules
All members, participants, guests, and visitors must comply with the following rules at all times while on the Hussar Stables premises. Violation of these rules may result in immediate removal from the premises and/or termination of membership without refund.
- Safety equipment: Approved ASTM/SEI-certified helmets must be worn at all times while mounted. No exceptions.
- Footwear: Boots with a heel of at least 1 inch must be worn while mounted. Open-toed shoes and sandals are prohibited in all horse areas.
- Horse handling: Only authorized personnel and assigned members may handle horses. Do not approach, feed, or interact with horses without instructor permission.
- Children under 18: Minors must be accompanied by a parent or guardian during all non-lesson times. Parents/guardians are responsible for their children's behavior on the premises.
- Alcohol and substances: Consumption of alcohol or controlled substances on the premises is strictly prohibited. Anyone appearing impaired will be asked to leave immediately.
- Photography and video: Photography and video of your own lessons is permitted. Recording other members, their children, or horses without explicit consent is prohibited.
- Pets: Pets are not permitted on the premises unless they are service animals with proper documentation.
- Property damage: Members are responsible for any damage to facility property, equipment, or horses caused by themselves or their minor children.
- Restricted areas: Access is limited to scheduled lesson times and designated areas. Entering horse stalls, feed areas, or restricted zones without authorization is prohibited.
- Respectful conduct: Abusive, threatening, or disrespectful behavior toward staff, instructors, other members, or horses will not be tolerated.
8. Minor Participants — Parental Consent and Responsibility
If you are enrolling a minor child in any Hussar Stables program, you represent that you are the parent or legal guardian of that child and that you have full legal authority to execute these Terms on the child's behalf. By enrolling a minor, you:
- Consent to the minor's participation in all equine activities at Hussar Stables
- Assume all risks on behalf of the minor as described in Section 2
- Execute the release of liability in Section 3 on behalf of the minor and yourself
- Authorize emergency medical treatment for the minor as described in Section 4
- Agree to supervise the minor during all non-lesson times on the premises
- Accept financial responsibility for any damage caused by the minor
- Acknowledge that you have explained the risks of equine activities to the minor in age-appropriate terms
You acknowledge that California courts have upheld parental waivers of liability on behalf of minor children in the context of commercial equine activities. However, you understand that this waiver may not be enforceable in all circumstances and that you are accepting this risk voluntarily.
9. Photography, Video, and Media Release
Adults. By participating in activities at Hussar Stables, adult participants grant Scrambled LLC dba Hussar Stables a perpetual, royalty-free, worldwide license to use photographs, videos, and other media taken of them during lessons, events, or on the premises for marketing, promotional, educational, and social media purposes, without compensation. Adults may opt out at any time by emailing info@hussarstables.com; we will stop using your image in new materials after we receive your request.
Minors. We do not use photographs, videos, or other media of a minor child for marketing, promotional, or social media purposes unless the child's parent or legal guardian has affirmatively opted in by checking the photo/media permission box on the signed liability waiver. Absent that opt-in, no license is granted for the minor's image. A guardian may withdraw a prior opt-in at any time by emailing info@hussarstables.com.
Neither an opt-out nor the absence of an opt-in affects Hussar Stables's right to photograph or record the general facility, horses, or other participants.
10. Intellectual Property
All content on the Hussar Stables website and in our curriculum materials — including text, images, videos, logos, curriculum documents, lesson plans, and training methodologies — is the exclusive intellectual property of Scrambled LLC dba Hussar Stables or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without the prior written consent of Scrambled LLC dba Hussar Stables. The EquestrianOS curriculum framework, level structure, and associated materials are proprietary and may not be copied or adapted for use at any other facility without express written permission.
11. Privacy and Data
Hussar Stables collects personal information including names, contact details, payment information, and health disclosures for the purpose of providing services, processing payments, communicating about lessons, and ensuring safety. We do not sell your personal information to third parties.
By providing your phone number, you consent to receive text messages from Hussar Stables regarding your lessons, membership, and facility updates. Standard message and data rates may apply. You may opt out at any time by replying STOP to any text message.
Payment information is processed through secure third-party payment processors and is not stored on our servers. We comply with applicable California privacy laws, including the California Consumer Privacy Act (CCPA). For data requests or deletion requests, contact us at info@hussarstables.com.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUSSAR STABLES LLC, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL LIABILITY OF HUSSAR STABLES LLC TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO HUSSAR STABLES LLC IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.
13. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of Hussar Stables's services shall be resolved as follows:
13.1 Informal Resolution
Before filing any formal claim, you agree to contact Hussar Stables at info@hussarstables.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve the dispute within 30 days.
13.2 Binding Arbitration
If informal resolution fails, any dispute shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, conducted in Los Angeles County, California. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
13.4 Venue
For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
14. Indemnification
You agree to defend, indemnify, and hold harmless Scrambled LLC dba Hussar Stables, its owners, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the facility or services, your participation in equine activities, your violation of any applicable law or regulation, or any activity of a minor child in your care.
15. Severability, Entire Agreement, and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with any signed membership agreement, liability waiver, and any other documents incorporated by reference, constitute the entire agreement between you and Scrambled LLC dba Hussar Stables with respect to your use of our services and supersede all prior and contemporaneous agreements, representations, and understandings.
No waiver by Scrambled LLC dba Hussar Stables of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Scrambled LLC dba Hussar Stables to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
